1. Acceptance of Terms

Cloudy Cuddles ("we," "us," or "our") operates this website (cloudycuddles.in) and brand store to provide you with soft toys, plushies, and related comforting products (the "Services"). By accessing or using our Services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our website or services. We reserve the right to update these Terms periodically, and your continued use of the site constitutes acceptance of those changes.

2. Use of Services

You agree to use our Services only for lawful purposes. Prohibited actions include, but are not limited to:

  • Copying, reproducing, or distributing our character designs, artwork, or website content without explicit written permission.

  • Interfering with site functionality, security features, or server integrity.

  • Posting or transmitting harmful, illegal, or infringing material. We reserve the right to suspend or terminate your access to our Services immediately for any violations.

3. Products and Orders

  • All plushie descriptions, character details, pricing, and availability are subject to change without prior notice.

  • Orders are not considered confirmed until payment is successfully processed and a confirmation email is sent.

  • All prices are listed in INR (Indian Rupee) and are exclusive of taxes and shipping unless stated otherwise.

  • We reserve the right to refuse, limit, or cancel any orders at our sole discretion.

4. Payments

Payments are processed securely through our authorized payment gateway partners. Accepted payment methods include credit/debit cards, net banking, UPI, and Cash on Delivery (COD).

  • COD Handling Fee: A flat handling fee of ₹50 applies to all COD orders.

  • You authorize us to charge your selected payment method. All charges are non-refundable except as explicitly outlined in our Return Policy.

5. Shipping and Delivery

  • Orders are packed with care and shipped within 24 hours from our facility in Maharashtra.

  • Standard delivery timelines typically range between 4–7 business days depending on your location.

  • Porter Services: Urgent local delivery via Porter can be arranged upon request via Instagram DM or email before ordering. All Porter charges must be borne by the customer.

  • Risk of loss passes to you upon delivery. Cloudy Cuddles is not liable for unexpected delays caused by shipping carriers or unforeseen transit disruptions.

6. Returns and Refunds

  • Returns are strictly accepted within 5 days of delivery and only for verified manufacturing defects, damage, or quality issues.

  • Conditions: Plushies must be completely unused, unwashed, unsoiled, and have all original tags firmly attached.

  • Exclusions & Requirements: No returns are accepted for change of mind, custom orders, or products missing a continuous, unedited unboxing video.

  • Refunds: Approved claims will be refunded to your original payment method within 7–10 business days. Original shipping and COD fees are non-refundable.

7. Intellectual Property

All content on this website—including character names, stories, plushie designs, logos, graphics, and brand aesthetics—is the exclusive intellectual property of Cloudy Cuddles. Your use of this site is strictly limited to personal, non-commercial purposes. Any unauthorized commercial reproduction, copying, or imitation of our plushie designs or brand assets is strictly prohibited and will result in legal action.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Cloudy Cuddles shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or website. Our total liability to you for any claim shall not exceed the actual amount paid by you for the specific product in question. Products are sold on an "as is" basis without warranties beyond those explicitly stated by us.

9. Force Majeure

Cloudy Cuddles is not responsible or liable for any delays, delivery failures, or service interruptions caused by events beyond our reasonable control, including but not limited to natural disasters, acts of God, strikes, pandemics, government restrictions, or major courier/logistics network disruptions.

10. Governing Law

These Terms of Service and any separate agreements shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Chhatrapati Sambhajinagar, Maharashtra.
